Charges and specifications have been preferred by his Commanding Officer against Captain Royce of the 44th Regiment New York Volunteers, and have been received by me from Headquarters of the 1st Division, 5th Army Corps, for trial before a General Court Martial ordered to assemble by General Order No. 13, from said Division Headquarters.
The Commanding Officer of the 44th Regiment New York Volunteers declines to place Captain Royce in arrest, because he, Captain Royce, has been detailed as a member of a Court of Commission, by order from the Headquarters of the army of the Potomac.
Captain Royce cannot be tried unless he is arrested.
This report is made respectfully requesting that Captain Royce be relieved from the Court of Commission in order that he be arrested and tried, or that instructions be given me on the matter.
